Welcome to VicastCam ("this Software")!

VicastCam products are provided only to users outside Mainland China. We do not actively promote the product to users in Mainland China. If you are located in Mainland China, please be aware that this product does not hold the relevant operational licenses required in Mainland China.

This End User License Agreement ("Agreement") is entered into between the Licensor and the user ("You", "User") of this Software, governing all your actions in downloading, installing, registering, logging into, and using this Software.

By clicking the "Agree" button in this Software, you voluntarily accept all terms of this Agreement; if you do not accept them, the Licensor does not grant you usage rights. Please immediately stop using and uninstall this Software. Your continued use of this Software signifies your agreement to and acceptance of this Agreement and any subsequent amendments.

You confirm that you are at least eighteen years old or have reached the legal age of majority in your jurisdiction ("adult"); minors must use this software with the explicit consent and full supervision of a legal guardian, who bears guardianship responsibilities in accordance with the law.

Scope of Application

1 Please read this entire Agreement carefully before using the Software, especially the core clauses regarding disclaimers, governing law, and dispute resolution, which are highlighted in bold. If you do not agree with any clause, please stop using the Software immediately.

2 This Software is primarily intended for adults. Minors must obtain consent from their legal guardian and use the Software under the guardian's supervision; the guardian must fulfill their legal guardianship duties.

3 This Agreement includes platform rules such as announcements, activity rules, and in-app notifications published within the Software. All platform rules form an integral part of this Agreement and have the same legal effect as this Agreement.

4 By registering, logging into, or using this Software, you are deemed to have fully read, understood, and agreed to be bound by this Agreement.

5 All intellectual property rights in this Software and any rights not expressly granted to users are reserved by the Licensor.

This Software and Related Services

1 This Software is an auxiliary tool designed for live streaming scenarios, providing functions such as live streaming push, virtual scene setup, AI intelligent matting, facial effects, and beauty filters. The specific services and functions are subject to the actual product display.

2 You may only obtain the client through official channels (Apple App Store or Google Play Store). Any risks or losses arising from using unofficial versions shall be borne by you.

3 To use this Software, you must prepare your own terminal device and internet connection and bear the associated internet access and data charges. Full functionality requires an internet connection.

4 The Licensor grants you a personal, non-commercial, non-transferable, revocable, non-exclusive license to use the Software. Without the prior written authorization of the Licensor, actions such as modifying, reproducing, distributing, mirroring, crawling, selling, or commercial use are prohibited.

5 The Licensor has the right to upgrade, adjust, suspend, or terminate part or all of the services based on needs such as product optimization, security maintenance, and compliance operations. You may choose whether to update the client; refusing an update may result in limited functionality. You have the right to uninstall this application at any time to terminate the service.

6 Purchase and Subscription Services

6.1 All paid features, purchases, and subscription services within this Software are transacted through the Apple App Store or Google Play Store payment system and are also subject to the terms of service of the respective platform.

6.2 Subscription Rules

(1) Auto-Renewal: Subscription services will be automatically charged at least 24 hours before the end of the current service period. The platform system will send renewal reminders. You can view, manage, and cancel auto-renewal at any time by going to your device's "Settings > Account > Subscriptions" page (the path may vary by platform).

(2) Price Changes: If subscription prices are adjusted, we will announce the change via in-app notices, the official website, or other means at least 30 days before the new price takes effect. Price adjustments will not affect the current active subscription period. Where local laws require additional user consent, we will comply accordingly.

(3) Free Trial: If a free trial is offered, please turn off auto-renewal at least 24 hours before the trial period ends to avoid being charged.

6.3 Regional Refunds and Statutory Right of Withdrawal

(1) Users in the European Union, European Economic Area, and the United Kingdom: In accordance with local consumer protection laws, you have a 14-day statutory right of withdrawal without giving any reason. See the "VicastCam Refund Policy" for details. Withdrawal and refund requests must be submitted through the official channel (App Store or Google Play) used for the purchase and are subject to the platform's rules and local laws. If the service has been used during the 14-day cooling-off period, the refund will be calculated proportionally based on the actual usage time. Upon withdrawal taking effect, your paid usage rights will terminate immediately.

(2) One-time Purchase or Lifetime Version: If you actively confirm immediate activation of the service and waive the 14-day right of withdrawal, the no-reason withdrawal rule will no longer apply.

(3) All Other Regions: Refunds and after-sales issues shall primarily follow the official rules of the platform through which you made the purchase.

6.4 Rules for Using Paid Benefits

(1) Paid services and benefits are for personal use only.

(2) It is prohibited to provide paid benefits to third parties through gifting, lending, renting, reselling, or bulk sharing.

7 Rules for Fees, Membership, and Commercial Use

7.1 The licensor has the right to charge fees for the software and related network services in accordance with the law. You shall bear all costs arising from the hardware, software, and network required for use, and pay the corresponding service fees on time.

7.2 You shall fulfill tax obligations in accordance with the law and bear all taxes and fees arising from the use of the service; it is prohibited to use paid services through fraudulent means.

7.3 We may adjust the membership system or terminate membership services based on legitimate operational needs. If an account is banned/terminated due to violations, paid fees will not be refunded.

7.4 If you need to use this software for commercial purposes, you must apply to the licensor in advance and obtain an official commercial use license.

7.5 It is prohibited to use this software to disseminate pornographic or illegal content for profit.

Account Management

1 You may independently register an account or use a legally compliant third-party platform account for authorized login. Third-party accounts must complete real-name authentication and comply with platform rules. You shall properly safeguard your account and password and are responsible for all actions taken under the account.

2 In accordance with global network supervision and real-name requirements, you must provide true, accurate, and valid identity information and contact details (such as email) when registering an account. If the information is false or questionable, the licensor has the right to request corrections, restrict or terminate services; for security verification purposes, certain registration information cannot be modified.

3 Some basic functions can be used without logging in; full functions and paid services require registration, login, and identity verification.

4 Account nicknames, avatars, bios, and other materials must not impersonate others' names, trademarks, portraits, or other legal rights, and must not contain illegal, vulgar, or misleading content. The licensor has the right to review account materials and take measures such as resetting, restricting functions, or banning accounts for violations.

5 Accounts are for personal use only and may be logged into on devices lawfully controlled by you. Gifting, lending, renting, transferring, or selling is prohibited. If the user is found to be inconsistent with the registrant, the licensor has the right to suspend or terminate services.

6 You are responsible for the security and confidentiality of your account and bear full legal responsibility for all operations, published content, and actions under the account.

7 If your account is stolen or you forget your password, you can retrieve it through the official appeal channel.

7.1 If your account is stolen, information is leaked, or property is lost due to improper safekeeping, device loss, or voluntary disclosure of account passwords, you shall bear all responsibility.

7.2 The account retrieval service only verifies information retained in the system and cannot determine the true identity of the user; you bear the related risks. If you detect any account anomalies, please contact official customer service immediately.

8 Account Cancellation and Data Processing

8.1 You may apply for account cancellation through the software's "My - Settings - Account Management - Cancel Account" or via the official email. Ownership verification must be completed before cancellation.

8.2 After account cancellation, a 30-day data buffer period is reserved (only for financial reconciliation, dispute resolution, and after-sales verification), after which permanent physical deletion will be executed. Exceptions apply to transaction records required by laws and regulations.

8.3 After account cancellation, the account and data cannot be recovered; obligations and liabilities incurred during your use are not exempted by cancellation.

User Conduct Rules

1 You undertake to comply with global laws on network security, intellectual property, portrait rights, and privacy rights during the use of this software, and to respect the legitimate rights and interests of others. Without legal permission or written authorization from the licensor, the following acts are prohibited:

1.1 Uploading or disseminating unauthorized personal information, trade secrets, or infringing content is prohibited.

1.2 Using plug-ins, add-ons, or third-party tools to interfere with or disrupt the normal operation of this software is prohibited.

1.3 Engaging in illegal network intrusions, data theft, virus dissemination, vulnerability scanning, or forging network data packets, among other cyber attacks, is prohibited.

1.4 Mass malicious registration of accounts is prohibited.

1.5 Reverse engineering, decompiling, disassembling, or attempting to crack the source code of this software is prohibited.

1.6 It is prohibited to produce or disseminate content that is pornographic, violent, defamatory, or in violation of laws and regulations.

1.7 It is prohibited to promote tobacco, alcohol, gambling, weapons, or prohibited items.

1.8 It is prohibited to engage in surreptitious photography, surreptitious recording, unauthorized recording, or dissemination of others' images, voices, or private information, thereby infringing upon others' portrait rights or privacy rights.

1.9 It is prohibited to engage in other acts that violate local laws, this Agreement, or platform rules.

1.10 In the event of a breach of this Agreement, the Licensor has the right to delete the violating content without notice and impose penalties including warnings, feature restrictions, device bans, or permanent account bans, depending on the severity of the violation; the violating user may submit an appeal via the official email, and the Licensor retains the final right of review.

2 When creating content using this Software, you are prohibited from using built-in materials, effects, or logos as third-party trademarks, logos, or commercial identifiers (except for content with your own copyright).

3 You shall not use this Software to publish or disseminate content involving violence, pornography, defamation, doxxing, infringement of others' privacy, spam advertisements, or any other content that violates laws, regulations, or public order and good customs.

4 The Licensor has the right to monitor and review user behavior, and upon discovering violations, may require rectification, deletion of content, or suspension or termination of services.

5 Specific Feature Restrictions

5.1 Camera and Live Streaming: Before using the camera, live streaming, or screen recording features, you must obtain explicit consent from all individuals being photographed or recorded. It is strictly prohibited to use this Software for illegal acts such as surreptitious photography, surreptitious recording, or illegal live streaming; you shall bear all related responsibilities.

5.2 AI Feature: The intellectual property rights of the AI algorithm, models, effects, and visual materials in this Software belong to the Licensor or authorized third parties. You may only use them for personal, non-commercial, legal creation, and are prohibited from producing deepfakes, fake audio/video, fraudulent content, or illegal content.

5.3 Regional Compliance: You must strictly comply with the regulatory requirements of your country/region regarding live streaming, portrait collection, and AI content.

6 If your violation causes losses to the Licensor, any fees paid will not be refunded, and you must fully compensate the Licensor for all economic and goodwill losses.

Personal Information Protection

1 We strictly process your personal information in compliance with the EU GDPR, the UK Data Protection Act, the Hong Kong Personal Data (Privacy) Ordinance, and data protection regulations worldwide. In accordance with Article 27 of the GDPR, we have appointed local compliance representatives in the EU and the UK; for specific contact details, please refer to the "GDPR and Data Protection" document.

2 You agree that the Licensor may collect, use, and store personal information in accordance with this Agreement and the Privacy Policy. The Privacy Policy has the same legal effect as this Agreement.

3 We employ security technologies such as encryption and anonymization to protect your personal information from leakage, tampering, and unauthorized access.

4 We will not share your personal information with third parties without your explicit consent, except in the following circumstances:

(1) You voluntarily disclose it to a third party;

(2) Based on national security, public safety, public health, and statutory judicial or administrative requirements;

(3) To protect the significant legitimate rights and interests of this Software, other users, or third parties, and in compliance with legal provisions;

(4) Information obtained from legally public channels;

(5) Other circumstances as provided by laws and regulations.

5 You have the legal right to inquire about, correct, delete, and withdraw authorization regarding your personal information. For detailed rules on personal information, please refer to the Privacy Policy.

Complaints and Reports

1 You may report violating content or file infringement complaints through the client or the official contact email.

2 If your rights are infringed, you may submit proof of rights to initiate a complaint; the complained party may submit proof of ownership to file an appeal.

3 We generally complete the review and provide feedback within 15 working days. For complex cases, we will update the processing progress.

Breach Handling

1 If you violate this Agreement, platform rules, or local laws and regulations, the Licensor may take measures such as warnings, feature restrictions, content deletion, service suspension, or permanent account bans. Any resulting losses shall be borne by you, and deleted content and data will not be restored.

2 If any suspected illegal or criminal activity is discovered, the Licensor will preserve evidence, report it to law enforcement authorities, and cooperate with investigations.

3 If your violation causes the Licensor to be subject to third-party claims, administrative penalties, or suffer reputational or economic losses, you shall bear all losses incurred by the Licensor.

Intellectual Property Rights

1 All intellectual property rights in the software code, interface, text, images, audio and video, special effects, trademarks, logos, and other content of this software are owned by the Licensor.

2 The Licensor holds all rights to the lawful data and information generated during the operation of the product.

3 Without the explicit written authorization of the Licensor, you are prohibited from using, copying, imitating, or registering brands, trademarks, domain names, logos, or identifiers related to "VicastCam"; any unauthorized use causing losses shall result in you bearing full legal liability.

4 This software contains software components distributed under open-source license agreements and third-party license agreements. Your use of such components must strictly comply with the corresponding license terms.

Terms for Minors

1 Minors must obtain explicit consent from their legal guardians before using this software and must use it under the supervision of their guardians. Guardians have the right to apply to restrict or cancel the accounts of minor users.

2 The Licensor carefully collects personal information of minor users. Guardians are required to guide minors in protecting their personal privacy and cybersecurity.

3 Guardians shall fulfill their custodial duties in accordance with the law, guiding minors to use the internet healthily and preventing internet addiction.

4 Minors and their guardians shall bear legal responsibility for all usage behaviors and consequences of the minor.

5 Minors are prohibited from using the camera for live streaming or appearing in videos alone, and must not publish illegal or vulgar content.

6 If the Licensor discovers that a minor is using the software without guardian consent, it has the right to directly restrict or block the corresponding account.

7 Guardians should properly safeguard payment account information and passwords to avoid unauthorized charges by minors; if there are any questions, please contact official customer service.

Disclaimer

1 You expressly acknowledge and agree that your use of this application is at your sole risk. To the maximum extent permitted by applicable law, this application and any services performed or provided by this application are provided "as is" and "as available" with all faults and without warranty of any kind, and the Licensor hereby disclaims all warranties and conditions with respect to this application and any services, either express, implied, or statutory, including, but not limited to, the implied warranties and/or conditions of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement of third-party rights. No oral or written information or advice given by the Licensor or its authorized representative shall create a warranty. Should this application or services prove defective, you assume the entire cost of all necessary servicing, repair, or correction. Some jurisdictions do not allow the exclusion of implied warranties or limitations on applicable statutory rights of a consumer, so the above exclusion and limitation may not apply to you.

2 The Licensor will adopt industry-standard security technologies to ensure stable service operation. In the event of service interruption or temporary data anomalies caused by force majeure, natural disasters, war, government bans, network failures, system maintenance, hacker attacks, viruses, third-party service failures, equipment abnormalities, or other factors beyond the Licensor's control, the Licensor shall not be liable for compensation to the extent permitted by laws and regulations.

3 If services are suspended or terminated due to system maintenance, version upgrades, compliance rectification, or business adjustments, we will provide reasonable advance notice through in-app announcements or on our official website.

4 Any damage to equipment or data loss resulting from your own operational errors, equipment failures, incorrect network settings, or unauthorized use of this software shall be borne entirely by you.

5 We reserve the right to adjust service functions, modify service content, or clean server data based on legitimate operational, system security, or compliance rectification reasons, and will not delete user data without cause.

6 Limitation of Liability

To the extent not prohibited by law, in no event shall the Licensor be liable for personal injury or any incidental, special, indirect, or consequential damages whatsoever, including, but not limited to, damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to your use or inability to use the Licensed Application, regardless of the theory of liability (contract, tort, or otherwise), even if the Licensor has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation of liability for personal injury or incidental or consequential damages, so this limitation may not apply to you.

Except as required by local law for personal injury, the Licensor's total liability to you for all damages shall not exceed 1 US dollar (USD 1.00). The foregoing limitations will apply even if the above-stated remedy fails of its essential purpose.

For jurisdictions such as the European Union, the European Economic Area, and the United Kingdom, this limitation of liability clause shall strictly apply in accordance with applicable local consumer protection laws.

Miscellaneous

1 Governing Law

This Agreement and the relationship between you and the Licensor shall be governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, excluding its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

2 Dispute Resolution

Any dispute arising out of or in connection with this Agreement shall first be resolved through friendly negotiations between the parties; if negotiations fail, you and the Licensor agree to submit the dispute to the competent courts located in the Hong Kong Special Administrative Region of the People's Republic of China.

If you are a resident of a European Union member state, this jurisdiction clause does not affect your statutory rights under applicable local mandatory consumer protection laws.

3 Agreement Amendments

The Licensor has the right to amend this Agreement during product testing and official operation, and shall publish such amendments through reasonable means such as in-product announcements or the official website. Once published, the amended terms become an integral part of this Agreement and have the same legal effect.

4 Relationship of Parties

You and the Licensor are independent civil subjects. This Agreement does not constitute any legal relationship such as agency, partnership, employment, affiliation, or joint venture. Apple Inc. and Google LLC serve solely as distribution and payment channels for this software and do not participate in its development or operation, nor assume any legal liability for this software or its services.

5 Effectiveness and Termination of Agreement

This Agreement takes effect from the date you agree to the terms and register an account; it terminates when the Licensor ceases services or when your usage rights are revoked. Upon termination, your obligations and liabilities during the period of validity shall remain in effect.

6 Headings

The headings of each section in this Agreement are for convenience only and do not affect the interpretation or application of the terms.

7 Copyright and Rights Statement

The copyright of this Agreement text belongs to the Licensor. The Licensor has the right to amend the Agreement in accordance with laws, regulations, and business needs, and holds the lawful right of interpretation.
