Welcome to VicastCam ("this Software")!

VicastCam products are provided only to users outside mainland China; we do not actively promote the product to users in mainland China. If you are located in mainland China, please be aware that this product does not hold the relevant operational licenses for mainland China.

This User License Agreement ("Agreement") is entered into between the Licensor and the user of this software ("You", "User") to govern all your actions in downloading, installing, registering, logging in, and using this software.

By clicking the "Agree" button in this Software, you voluntarily accept all terms of this Agreement; if you do not accept them, the Licensor does not grant you usage rights. Please immediately stop using and uninstall this Software. Your continued use of this Software signifies your agreement to and acceptance of this Agreement and any subsequent amendments.

You confirm that you are at least eighteen years old or have reached the legal age of majority in your jurisdiction ("adult"); minors must use this software with the explicit consent and full supervision of their legal guardians, who bear guardianship responsibilities in accordance with the law.

Scope of Application

1 Please read this entire Agreement carefully before use, especially the core clauses highlighted in bold, such as disclaimers, governing law, and dispute resolution. If you do not agree with any clause, please stop using immediately.

2 This Software is primarily intended for adults. Minors must obtain consent from their legal guardians before using this Software and must use it under the supervision of their guardians; guardians must fulfill their custodial duties in accordance with the law.

3 This Agreement includes platform rules such as announcements, activity rules, and in-app notifications published on this Software. All platform rules are an integral part of this Agreement and have the same legal effect as this Agreement.

4 By registering, logging in, or using this Software, you are deemed to have fully read, understood, and agreed to be bound by this Agreement.

5 All intellectual property rights and rights not expressly granted to users in this Software are owned by the Licensor.

This Software and Related Services

1 This Software is an auxiliary tool for live streaming scenarios, providing functions such as live streaming push, virtual scene setup, AI intelligent matting, facial effects, and beauty filters. Specific services and functions are subject to the actual product display.

2 You may only obtain the client through official channels (Apple App Store or Google Play Store). Any risks and losses arising from using unofficial versions shall be borne by you.

3 To use this Software, you need to prepare your own terminal device and network connection and bear the corresponding internet and data costs. Full functionality requires an internet connection.

4 The Licensor grants you a personal, non-commercial, non-transferable, revocable, non-exclusive license to use the Software. Without prior written authorization from the Licensor, actions such as modification, reproduction, distribution, mirroring, crawling, selling, or commercial use are prohibited.

5 The Licensor has the right to upgrade, adjust, suspend, or terminate part or all of the services based on product optimization, security maintenance, compliance operations, and other needs. You may choose whether to update the client; refusing to update may result in limited functionality. You have the right to uninstall this application at any time to terminate the service.

6 Purchase and Subscription Services

6.1 All paid features, purchases, and subscription services within this Software are transacted through the Apple App Store or Google Play store payment system, and such transactions are also subject to the service terms of the respective platform.

6.2 Subscription Rules

(1) Auto-Renewal: Subscription services will automatically be charged at least 24 hours before the end of the current service period, and the platform system will send renewal reminders. You can view, manage, and cancel auto-renewal at any time by going to your device's "Settings > Account > Subscriptions" page (the path may vary by platform).

(2) Price Changes: If subscription prices are adjusted, we will announce the change through in-app notices, the official website, or other means at least 30 days before the new price takes effect. Price adjustments will not affect the current active subscription period. Where local laws require additional user consent, we will comply accordingly.

(3) Free Trial: If a free trial is offered, please turn off auto-renewal at least 24 hours before the trial period ends to avoid being charged.

6.3 Regional Refunds and Statutory Right of Withdrawal

(1) Users in the European Union, European Economic Area, and the United Kingdom: In accordance with local consumer protection laws, you have a 14-day statutory right of withdrawal without giving any reason, as detailed in the "VicastCam Refund Policy." Withdrawal and refund requests must be submitted through the official channel (App Store or Google Play) used for the purchase, and refunds are subject to platform rules and local laws. If the service has been used during the 14-day cooling-off period, the refund will be calculated proportionally based on the actual usage time; upon withdrawal taking effect, your paid usage rights will terminate immediately.

(2) One-time Payment or Lifetime Version Services: If you actively confirm immediate activation of the service and waive the 14-day right of withdrawal, the no-reason withdrawal rule will no longer apply.

(3) All Other Regions: Refunds and after-sales issues will primarily follow the official rules of the platform through which you made the purchase.

6.4 Aturan Penggunaan Hak Berbayar

(1) Layanan berbayar dan hak hanya dapat digunakan oleh pemilik akun.

(2) Dilarang memberikan hak berbayar kepada pihak ketiga dalam bentuk hadiah, pinjaman, sewa, penjualan kembali, atau berbagi massal.

7 Aturan Biaya, Keanggotaan, dan Penggunaan Komersial

7.1 Pemberi lisensi berhak mengenakan biaya untuk perangkat lunak dan layanan jaringan pendukung sesuai hukum. Anda harus menanggung sendiri seluruh biaya perangkat keras, perangkat lunak, dan jaringan yang diperlukan, serta membayar biaya layanan terkait tepat waktu.

7.2 Anda harus memenuhi kewajiban perpajakan sesuai hukum dan menanggung sendiri seluruh pajak yang timbul dari penggunaan layanan; dilarang menggunakan layanan berbayar dengan cara curang.

7.3 Kami dapat menyesuaikan sistem keanggotaan atau menghentikan layanan keanggotaan berdasarkan kebutuhan operasional yang sah. Jika akun diblokir/dihentikan karena pelanggaran, biaya yang telah dibayarkan tidak akan dikembalikan.

7.4 Jika Anda perlu menggunakan perangkat lunak ini untuk tujuan komersial, Anda harus mengajukan permohonan kepada pemberi lisensi terlebih dahulu dan mendapatkan lisensi penggunaan komersial resmi.

7.5 Dilarang menggunakan perangkat lunak ini untuk menyebarkan konten pornografi, ilegal, dan mencari keuntungan.

Manajemen Akun

1 Anda dapat mendaftarkan akun secara mandiri atau menggunakan akun pihak ketiga yang sah dan sesuai untuk login otorisasi. Akun pihak ketiga harus menyelesaikan verifikasi identitas asli dan memenuhi aturan platform. Akun dan kata sandi harus disimpan dengan baik oleh Anda, dan Anda bertanggung jawab atas semua tindakan akun.

2 Sesuai dengan persyaratan pengawasan jaringan dan verifikasi identitas asli di seluruh dunia, saat mendaftarkan akun, Anda harus memberikan informasi identitas dan kontak (seperti email) yang benar, akurat, dan valid. Jika informasi tidak benar atau diragukan, pemberi lisensi berhak meminta koreksi, membatasi, atau menghentikan layanan; karena kebutuhan verifikasi keamanan, beberapa informasi pendaftaran tidak dapat diubah.

3 Beberapa fungsi dasar dapat digunakan tanpa login; fungsi lengkap dan layanan berbayar memerlukan pendaftaran, login, dan verifikasi identitas.

4 Nama panggilan akun, avatar, biografi, dan materi lainnya tidak boleh menggunakan nama orang lain, merek dagang, potret, dan hak hukum lainnya secara tidak sah, tidak boleh mengandung konten ilegal, vulgar, atau menyesatkan publik. Pemberi lisensi berhak meninjau materi akun dan mengambil tindakan seperti mengatur ulang, membatasi fungsi, atau memblokir akun untuk materi yang melanggar.

5 Akun hanya dapat digunakan oleh pemilik, dan dapat login di perangkat yang dikendalikan secara sah oleh pemilik. Dilarang memberikan, meminjamkan, menyewakan, mentransfer, atau menjual. Jika ditemukan ketidaksesuaian antara pengguna dan pendaftar, pemberi lisensi berhak menangguhkan atau menghentikan layanan.

6 Anda bertanggung jawab atas keamanan dan kerahasiaan akun, dan menanggung semua tanggung jawab hukum atas semua operasi, konten yang dipublikasikan, dan tindakan di bawah akun.

7 Jika akun dicuri atau kata sandi lupa, dapat dipulihkan melalui saluran pengaduan resmi.

7.1 Jika akun dicuri, informasi bocor, atau kerugian properti terjadi karena penyimpanan yang tidak tepat, kehilangan perangkat, atau pengungkapan kata sandi akun secara sengaja oleh Anda, Anda menanggung sendiri semua tanggung jawab.

7.2 Layanan pemulihan akun hanya memverifikasi informasi yang tersimpan dalam sistem, tidak dapat menentukan identitas asli pengguna, dan risiko terkait ditanggung oleh Anda. Jika ditemukan kelainan akun, segera hubungi layanan pelanggan resmi untuk penanganan.

8 Penghapusan Akun dan Pemrosesan Data

8.1 Anda dapat mengajukan penghapusan akun melalui "Saya - Pengaturan - Manajemen Akun - Hapus Akun" di perangkat lunak ini atau melalui email resmi. Sebelum penghapusan, verifikasi kepemilikan harus diselesaikan.

8.2 Setelah penghapusan akun, periode penyangga data 30 hari disediakan (hanya untuk rekonsiliasi keuangan, sengketa hak, verifikasi purna jual), setelah itu penghapusan fisik permanen akan dilakukan. Kecuali untuk bukti transaksi yang harus disimpan sesuai hukum.

8.3 Setelah penghapusan akun, akun dan data tidak dapat dipulihkan; kewajiban dan tanggung jawab yang timbul selama penggunaan tidak dihapuskan karena penghapusan.

Aturan Perilaku Pengguna

1 Anda berjanji untuk mematuhi hukum terkait keamanan jaringan global, kekayaan intelektual, hak potret, hak privasi, dan menghormati hak hukum orang lain selama menggunakan perangkat lunak ini. Tanpa izin hukum atau otorisasi tertulis dari pemberi lisensi, dilarang melakukan hal berikut:

1.1 Dilarang mengunggah atau menyebarkan informasi pribadi, rahasia dagang, atau konten pelanggaran yang tidak sah.

1.2 Dilarang menggunakan program eksternal, plugin, atau alat pihak ketiga untuk mengganggu atau merusak pengoperasian normal perangkat lunak ini.

1.3 Dilarang melakukan intrusi jaringan ilegal, pencurian data, penyebaran virus, pemindaian kerentanan, pemalsuan paket data jaringan, dan tindakan serangan jaringan lainnya.

1.4 Dilarang mendaftarkan akun secara massal dengan itikad buruk.

1.5 Dilarang melakukan rekayasa balik, dekompilasi, disassembly, atau mencoba memecahkan kode sumber perangkat lunak ini.

1.6 Dilarang membuat dan menyebarkan konten pornografi, kekerasan, fitnah, serta konten yang melanggar hukum dan peraturan.

1.7 Dilarang mempromosikan tembakau, alkohol, perjudian, senjata, dan barang terlarang.

1.8 Dilarang memotret, merekam secara diam-diam, merekam tanpa izin, menyebarkan gambar, suara, dan informasi pribadi orang lain, serta melanggar hak potret dan hak privasi orang lain.

1.9 Dilarang melakukan tindakan lain yang melanggar hukum setempat, perjanjian ini, dan aturan platform.

1.10 Jika melanggar ketentuan perjanjian ini, Pemberi Lisensi berhak menghapus konten yang melanggar tanpa pemberitahuan, dan memberikan sanksi berupa peringatan, pemblokiran fungsi, pemblokiran perangkat, pemblokiran akun permanen, dan sanksi lainnya sesuai dengan tingkat pelanggaran; pengguna yang melanggar dapat mengajukan banding melalui email resmi, dan Pemberi Lisensi memiliki hak akhir untuk meninjau.

2 Saat Anda menggunakan perangkat lunak ini untuk membuat konten, dilarang menggunakan materi bawaan, efek, dan logo perangkat lunak untuk merek dagang, logo, dan identitas komersial pihak ketiga (kecuali konten yang memiliki hak cipta sendiri).

3 Anda tidak boleh menggunakan perangkat lunak ini untuk menerbitkan atau menyebarkan konten kekerasan, pornografi, penghinaan dan fitnah, doxing, pelanggaran privasi orang lain, spam, serta konten lain yang melanggar hukum, peraturan, dan ketertiban umum.

4 Pemberi Lisensi berhak mengawasi dan memeriksa perilaku pengguna, dan jika ditemukan pelanggaran, dapat meminta perbaikan, penghapusan konten, penghentian sementara atau penghentian layanan.

5 Batasan Fungsi Khusus

5.1 Kamera dan Siaran Langsung: Sebelum menggunakan fungsi kamera, siaran langsung, dan perekaman layar, Anda harus mendapatkan persetujuan tegas dari semua orang yang difoto atau direkam. Dilarang keras menggunakan perangkat lunak ini untuk melakukan tindakan ilegal seperti memotret diam-diam, merekam diam-diam, dan siaran langsung ilegal, dan tanggung jawab terkait sepenuhnya ditanggung oleh Anda.

5.2 Fungsi AI: Hak kekayaan intelektual atas algoritma, model, efek, dan materi visual AI dari perangkat lunak ini sepenuhnya dimiliki oleh Pemberi Lisensi atau pihak ketiga mitra. Anda hanya dapat menggunakannya untuk pembuatan konten legal non-komersial pribadi, dan dilarang membuat deepfake, audio dan video palsu, penipuan, serta konten ilegal.

5.3 Kepatuhan Wilayah: Anda harus mematuhi secara ketat peraturan pengawasan di negara/wilayah tempat Anda berada terkait siaran langsung, pengumpulan gambar wajah, dan konten AI.

6 Jika Anda menyebabkan kerugian pada Pemberi Lisensi karena penggunaan yang melanggar aturan, biaya yang telah dibayarkan tidak akan dikembalikan, dan Anda harus mengganti seluruh kerugian ekonomi dan reputasi Pemberi Lisensi.

Perlindungan Informasi Pribadi

1 Kami memproses informasi pribadi Anda dengan mematuhi secara ketat GDPR Uni Eropa, Undang-Undang Perlindungan Data Inggris, Peraturan Perlindungan Data Pribadi (Privasi) Hong Kong, serta peraturan perlindungan data di seluruh dunia. Berdasarkan Pasal 27 GDPR, kami telah menunjuk perwakilan kepatuhan lokal di Uni Eropa dan Inggris, dan informasi kontak terperinci dapat ditemukan dalam dokumen "GDPR dan Perlindungan Data".

2 Anda menyetujui Pemberi Lisensi untuk mengumpulkan, menggunakan, dan menyimpan informasi pribadi sesuai dengan perjanjian ini dan "Kebijakan Privasi". "Kebijakan Privasi" memiliki kekuatan hukum yang setara dengan perjanjian ini.

3 Kami menggunakan teknologi keamanan seperti enkripsi dan anonimisasi untuk melindungi informasi pribadi Anda, mencegah kebocoran, perubahan, dan akses ilegal terhadap informasi.

4 Tanpa persetujuan tegas dari Anda, kami tidak akan membagikan informasi pribadi Anda kepada pihak ketiga, kecuali dalam situasi berikut:

(1) Anda sendiri yang mengungkapkannya kepada pihak ketiga;

(2) Berdasarkan keamanan nasional, keselamatan publik, kesehatan masyarakat, serta persyaratan hukum peradilan dan administratif;

(3) Untuk melindungi kepentingan sah yang signifikan dari perangkat lunak ini, pengguna lain, dan pihak ketiga, dan sesuai dengan ketentuan hukum;

(4) Informasi yang diperoleh dari saluran publik yang sah;

(5) Situasi lain yang ditentukan oleh hukum dan peraturan.

5 Anda berhak berdasarkan hukum untuk melakukan permintaan, koreksi, penghapusan, dan pencabutan otorisasi atas informasi pribadi. Untuk aturan terperinci tentang informasi pribadi, silakan lihat "Kebijakan Privasi".

Pengaduan dan Pelaporan

1 Anda dapat melaporkan konten yang melanggar dan mengadukan pelanggaran hak melalui klien atau email kontak resmi.

2 Jika hak Anda dilanggar, Anda dapat mengajukan pengaduan dengan menyerahkan bukti hak, dan pihak yang diadukan dapat mengajukan banding dengan menyerahkan bukti kepemilikan.

3 Kami umumnya menyelesaikan verifikasi dan memberikan hasil dalam waktu 15 hari kerja. Kasus yang kompleks akan disertai dengan pembaruan kemajuan.

Penanganan Pelanggaran

1 Jika Anda melanggar perjanjian ini, aturan platform, dan hukum serta peraturan setempat, Pemberi Lisensi dapat mengambil tindakan seperti peringatan, pembatasan fungsi, penghapusan konten, penghentian sementara layanan, dan pemblokiran akun permanen. Kerugian yang timbul akibat hal ini sepenuhnya ditanggung oleh Anda, dan konten serta data yang telah dihapus tidak dapat dipulihkan.

2 If any suspected illegal or criminal activity is discovered, the Licensor will preserve evidence, report it to law enforcement authorities, and cooperate with investigations.

3 If your violation causes the Licensor to face third-party claims, administrative penalties, or goodwill or economic losses, you must bear all losses incurred by the Licensor.

Intellectual Property Rights

1 All intellectual property rights in the software code, interface, text, images, audio and video, special effects, trademarks, logos, and other content of this Software are owned by the Licensor.

2 The Licensor holds all rights to the legitimate data and information generated during the operation of the product.

3 Without the explicit written authorization of the Licensor, you are prohibited from using, copying, imitating, or registering brands, trademarks, domain names, logos, or identifiers related to "VicastCam"; any violation causing losses shall result in you bearing full legal liability.

4 This Software contains software components distributed under open-source license agreements and third-party license agreements. Your use of such components must strictly comply with the corresponding license terms.

Terms for Minor Users

1 Minors must obtain explicit consent from their legal guardians before using this Software and must use it under the supervision of their guardians. Guardians have the right to request the restriction or cancellation of minor user accounts.

2 The Licensor carefully collects personal information of minor users. Guardians are required to guide minors in protecting their personal privacy and cybersecurity.

3 Guardians shall fulfill their guardianship duties in accordance with the law, guiding minors to use the internet healthily and preventing internet addiction.

4 Minors and their guardians shall bear legal responsibility for all usage behaviors and consequences of the minor.

5 Minors are prohibited from using the camera for live streaming or appearing in videos alone, and must not post illegal or vulgar content.

6 If the Licensor discovers that a minor is using the Software without guardian consent, it has the right to directly restrict or block the corresponding account.

7 Guardians should properly safeguard payment accounts and passwords to avoid unauthorized charges by minors; if you have any questions, please contact official customer service.

Disclaimer

1 You expressly acknowledge and agree that your use of this Application is at your sole risk. To the maximum extent permitted by applicable law, this Application and any services performed or provided by this Application are provided "as is" and "as available" with all faults, and without warranty of any kind, and the Licensor hereby disclaims all warranties and conditions with respect to this Application and any services, either express, implied, or statutory, including, but not limited to, the implied warranties and/or conditions of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement of third-party rights. No oral or written information or advice given by the Licensor or its authorized representative shall create a warranty. Should this Application or any services prove defective, you assume the entire cost of all necessary servicing, repair, or correction. Some jurisdictions do not allow the exclusion of implied warranties or limitations on applicable statutory rights of a consumer, so the above exclusion and limitation may not apply to you.

2 The Licensor will adopt industry-standard security technologies to ensure stable service operation. To the extent permitted by laws and regulations, the Licensor shall not be liable for compensation for service interruptions or temporary data anomalies caused by force majeure, natural disasters, war, government bans, network failures, system maintenance, hacker attacks, viruses, third-party service failures, equipment abnormalities, or other factors beyond the Licensor's control.

3 If services are suspended or terminated due to system maintenance, version upgrades, compliance rectification, or business adjustments, we will provide reasonable advance notice through in-app announcements and the official website.

4 Any damage to equipment or data loss resulting from your own operational errors, equipment failures, incorrect network settings, or improper use of this Software shall be borne entirely by you.

5 We have the right to adjust service functions, modify service content, or clean server data based on legitimate operational, system security, or compliance rectification reasons, and will not delete user data without cause.

6 Limitation of Liability

To the extent not prohibited by law, in no event shall the Licensor be liable for personal injury or any incidental, special, indirect, or consequential damages, including but not limited to loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to your use of or inability to use the Licensed Application, regardless of the theory of liability (contract, tort, or otherwise), even if the Licensor has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation of liability for personal injury or incidental or consequential damages, so this limitation may not apply to you.

Except as required by local law for personal injury, the Licensor's total liability to you for all damages shall not exceed 1 US Dollar (USD 1.00). The foregoing limitations will apply even if the above-stated remedy fails of its essential purpose.

For jurisdictions such as the European Union, the European Economic Area, and the United Kingdom, this limitation of liability clause shall strictly apply in accordance with applicable local consumer protection laws.

Miscellaneous

1 Governing Law

This Agreement and the relationship between you and the Licensor shall be governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, excluding conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.

2 Dispute Resolution

Any dispute arising out of or in connection with this Agreement shall first be resolved through friendly negotiation between the parties; if negotiation fails, you and the Licensor agree to submit the dispute to the competent courts located in the Hong Kong Special Administrative Region of the People's Republic of China.

If you are a resident of a European Union member state, this jurisdiction clause does not affect your statutory rights under applicable local mandatory consumer protection laws.

3 Agreement Amendments

The Licensor has the right to amend this Agreement during product testing and formal operation periods, and shall announce such amendments through reasonable means such as in-product notifications or the official website. Once the amended terms are published, they become an integral part of this Agreement and have the same legal effect.

4 Relationship of the Parties

You and the Licensor are independent civil subjects. This Agreement does not constitute any legal relationship such as agency, partnership, employment, affiliation, or joint venture. Apple Inc. and Google LLC serve only as distribution and payment channels for this software and do not participate in the development or operation of this software, nor do they assume any legal liability for this software or its services.

5 Effectiveness and Termination of the Agreement

This Agreement takes effect from the date you agree to the terms and register an account; it terminates when the Licensor ceases services or when your usage rights are revoked. Upon termination, your obligations and liabilities during the period of validity shall remain in effect.

6 Headings

The headings of each section in this Agreement are for convenience only and do not affect the interpretation or application of the terms.

7 Copyright and Rights Statement

The copyright of this Agreement text belongs to the Licensor. The Licensor has the right to amend the Agreement in accordance with laws, regulations, and business needs, and holds the lawful right of interpretation.
